These Terms of Use govern your access to and use of Hoist, including the Hoist iOS app and hoist.life. By using Hoist, you agree to these terms.
Who we are
Hoist is provided by Akult Incorporated. Hoist helps users generate, track, and adapt fitness training through software, workout history, user-provided training context, and AI-assisted generation.
Fitness and medical disclaimer
Hoist is not a medical device and does not provide medical advice, diagnosis, treatment, physical therapy, or emergency services. Workout suggestions may be inappropriate for your body, health, equipment, experience, or environment. You are responsible for deciding whether a workout is safe for you. Stop exercising and seek professional help if you experience pain, dizziness, shortness of breath, or other concerning symptoms.
Your responsibilities
- Provide accurate information about your goals, limitations, injuries, preferences, and training context.
- Use good judgment and adapt or skip exercises that are unsafe or unsuitable.
- Keep your account secure and do not misuse the service.
- Do not use Hoist for unlawful, harmful, abusive, or infringing activity.
Subscriptions and billing
Hoist may offer auto-renewable subscriptions through Apple In-App Purchase. Subscription pricing, trial or introductory offers, renewal terms, cancellation, and refunds are handled through Apple and shown in the App Store purchase flow. You can manage or cancel subscriptions in your Apple App Store account settings. Hoist does not receive your full payment card details.
AI-generated content
Hoist may generate workouts, explanations, or recommendations using automated systems. AI-generated content can be incomplete, inaccurate, or unsuitable. You should review all generated training before performing it and should not rely on Hoist as a substitute for professional medical, fitness, or safety advice.
Acceptable use
You agree not to:
- Reverse engineer, disrupt, overload, or attack Hoist or its infrastructure.
- Attempt to access another user’s account or data.
- Use Hoist to submit malicious code, abusive content, or unlawful material.
- Resell, sublicense, or commercially exploit Hoist without written permission.
Intellectual property
Hoist, including its software, design, brand, text, graphics, and other content, is owned by Akult Incorporated or its licensors. You may use Hoist only as permitted by these terms and applicable app-store rules.
Service changes
We may change, suspend, or discontinue parts of Hoist at any time. We may also update these terms. Continued use after changes means you accept the updated terms.
Disclaimers
Hoist is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that Hoist will be uninterrupted, error-free, or that any workout or recommendation will meet your needs.
Limitation of liability
To the fullest extent permitted by law, Akult Incorporated will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or other damages arising from your use of Hoist, except where liability cannot be limited by law.
Apple terms
If you downloaded Hoist from Apple’s App Store, Apple’s standard App Store terms and policies may also apply to your use of the app and any in-app purchases.
